J&K Government Dismisses School Teacher from Service Under Article 311(2)(b)

Srinagar, September 21: The Jammu and Kashmir Government’s School Education Department has dismissed a Government school teacher from service with immediate effect and disqualified him from future employment in the government service of the Union Territory. According to Government Order No. 388-JK(Edu) of 2026, dated September 21, 2026, the order concerns Khalid Hussain, Teacher Grade-II, posted at Government Middle School, Bumalpora, Gurinalla, Zone Inderwal, District Kishtwar. The Government stated that Hussain was already under suspension and that an FIR had been registered at Police Station Chatroo in connection with offences under provisions of the Bharatiya Nyaya Sanhita (BNS), 2023, and the Protection of Children from Sexual Offences (POCSO) Act, 2012. The order states that, after considering the facts and circumstances of the case and the material available on record, the competent authority decided to impose the major penalty of dismissal from service. The Government invoked sub-clause (b) of the proviso to clause (2) of Article 311 of the Constitution of India, read with Rule 30(viii) of the J&K Civil Services (Classification, Control and Appeal) Rules, 1956. The Government said it was not reasonably practicable to hold a regular departmental inquiry in the case and concluded that the teacher’s continued employment would be detrimental to the interests of the Government and could erode public trust in government institutions. The dismissal carries disqualification from any future employment in the Government service of the Union Territory of Jammu and Kashmir. In a separate press release, the School Education Department said the teacher was in judicial custody in connection with a case registered under the BNS and the POCSO Act. It stated that the criminal investigation and trial are being pursued by the concerned law-enforcement authorities in accordance with law. The department also said that, in keeping with the confidentiality requirements under Section 23 of the POCSO Act, no further details identifying the victim, school or location were being disclosed.
